Purpose of Service

"You", "your", and "user" are words in this Terms of Use that are used interchangeably and mean anyone, whether an individual, natural person or under or for any legal entity, whether plural or singular, that accesses and/or uses Dream Smith AI services. Any such user hereby warrants that the user is of full legal age to contract in their respective legal jurisdiction.

Dream Smith AI provides creative generative AI tools for everyone to express their creativity through AI-powered image and video generation.

Privacy

Dream Smith AI takes precautions to protect users' personal data in a manner compliant with applicable data protection regulations, including the General Data Protection Regulation (GDPR) for users in the European Union. To exercise your data rights, contact us at support@dreamsmith.ai.

Dream Smith AI agrees never to sell or release to any 3rd party your private information, except in accord with any public sale, merger, or other acquisition of Dream Smith AI or as required by law.

Private Information Stored

• The inputs (prompts) provided by each unique user for each generation
• The unique social IDs of the user, if provided through social authentication
• Email address and account information
• Transaction and payment history

Ownership Rights

You retain ownership rights to any content you create using Dream Smith AI services. However, by using our services, you grant Dream Smith AI a perpetual, irrevocable, worldwide, transferable, sub-licensable, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content for the purposes of providing and improving our services.

You also grant each other user of the Service a worldwide, non-exclusive, royalty-free license to access your public content through the Service, and to use that content only as enabled by features of the Service.

Prompt & Content Guidelines

Dream Smith AI should NOT be used for:

• Any activity that violates applicable national, federal, state, local or international law
• Exploiting, harming or attempting to harm minors in any way
• Generating or disseminating verifiably false information with the purpose of harming others
• Generating personal identifiable information that can be used to harm an individual
• Defaming, disparaging or harassing others
• Discriminating against individuals based on protected characteristics
• Generating pornographic or explicit sexual content
• Creating content that exploits vulnerabilities of specific groups
• Providing medical advice or medical results interpretation
• Generating content for law enforcement or immigration processes
• Using copyrighted or trademarked material in prompts

Sexual Content Policy

We prohibit any activity that involves sexual exploitation or abuse of a minor, including generating child sexual exploitation imagery, grooming, or sexual extortion. We report all instances of child sexual exploitation to authorities.

We prohibit generating, promoting, distributing, or sharing pornographic content. We also don't allow commercial activities that relate to pornography or sexual interactions. Breastfeeding and other depictions of nudity in non-sexual contexts are generally permitted.

Content that violates our guidelines will be removed. Users who generate, share, or distribute violating content will have their accounts terminated.

Harassment & Bullying

We prohibit bullying or harassment of any kind, including sending unwanted sexually explicit, suggestive, or nude images to other users. If someone blocks you, you may not contact them from another account.

Sharing images of a person without their consent, or sharing another person's private information for the purpose of harassment ("doxxing") is prohibited.

Threats, Violence & Harm

Encouraging or engaging in violent or dangerous behavior is prohibited. Never intimidate or threaten to harm a person, a group of people, or someone's property. Creation of gratuitous or graphic violence, including animal abuse, is not allowed. We don't allow the glorification of self-harm, including the promotion of self-injury, suicide, or eating disorders.

Harmful False or Deceptive Information

• We prohibit spreading false information that causes harm or is malicious
• We prohibit pretending to be someone you're not, or impersonation for harmful purposes
• We prohibit spam, undisclosed paid content, and pyramid schemes
• We prohibit fraud and deceptive practices, including imitating Dream Smith AI

Illegal or Regulated Activities

Don't use Dream Smith AI to generate content that's illegal in your jurisdiction, or for any illegal activity. This includes generating, promoting, or facilitating criminal activity such as sales of illegal drugs, weapons, or counterfeit goods. We prohibit any form of exploitation, including sex trafficking, labor trafficking, or human trafficking.

Hateful Content, Terrorism & Violent Extremism

Terrorist organizations, violent extremists, and hate groups are prohibited from using our platform. We have no tolerance for content that advocates or advances terrorism or violent extremism. Hate speech or content that promotes discrimination or violence based on race, color, ethnicity, national origin, religion, sexual orientation, gender, disability, or other protected characteristics is prohibited.

Fees and Payments

Billing

You may purchase credits or subscriptions directly from Dream Smith AI. Tax rates are calculated based on the information you provide and the applicable rate at the time of your charge.

Price Changes

Dream Smith AI may make changes to pricing from time to time and will communicate any price changes to you in advance. By continuing to use the service after a price change takes effect, you accept the new pricing.

Refunds

We do not provide refunds or credits for any partial subscription periods or unused credits, except as expressly stated in these Terms or required by law.

Indemnity Clause

Users, by use of Dream Smith AI, hereby agree to indemnify and hold harmless Dream Smith AI against any and all claims, demands, charges, complaints, controversies, and causes of action of any kind arising out of and relating to intellectual property infringement claims or your use of the service. This indemnity includes reimbursement for any applicable court costs, legal fees, and expenses of litigation.

Enforcement

If you violate these Terms & Conditions or Community Guidelines, we may:

• Remove the offending content immediately
• Terminate or limit the visibility of your account
• Permanently delete all associated files and data
• Notify law enforcement when activity poses a threat
• Ban you from using Dream Smith AI services permanently

If your account is terminated for violating these Terms, you are not allowed to use Dream Smith AI again or circumvent this termination in any way.
